• Store and manage rendered images
• Access various subscription tiers with different features and credits

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You may register using email/password or through Google OAuth authentication.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

You must be at least 18 years old to use this Service. By creating an account, you represent that you meet this age requirement.

4. Subscription Plans and Billing

4.1 Subscription Tiers

4.2 Payment Terms

• Paid subscriptions are billed monthly in advance
• All fees are non-refundable except as required by law
• We use Stripe for payment processing and do not store your payment information
• You authorize us to charge your payment method for all fees incurred

4.3 Credits and Usage

• Rendering credits are allocated based on your subscription tier
• Credits renew monthly on your billing date
• Unused credits do not roll over to the next billing period
• Credit costs vary by AI model and rendering resolution

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial months or unused credits
• Upon cancellation, you retain access to your account and data until the end of the paid period

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Service for lawful purposes related to architectural visualization and design.

5.2 Prohibited Activities

You agree NOT to:

• Upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any intellectual property rights, including copyrights, trademarks, or patents
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service to generate spam or unsolicited communications
• Resell, redistribute, or sublicense access to the Service
• Upload malware, viruses, or malicious code
• Abuse the Service through excessive API calls or resource consumption

6. Content and Intellectual Property

• Create thumbnails and previews of your content

You own the renderings generated through the Service. However, you acknowledge that:

• Similar prompts may produce similar results for different users
• You are responsible for ensuring your use of generated content complies with applicable laws

6.3 Our Intellectual Property

The Service, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

6.4 Watermarks

Free tier users' renderings will include a watermark ("arch-ai.link"). Paid tier users receive renderings without watermarks.

7. Privacy and Data

7.1 Data Collection

We collect and process data as described in our Privacy Policy, including:

• Account information (email, name)
• Usage data (renderings, prompts, files uploaded)
• Payment information (processed by Stripe)
• Technical data (IP address, browser type, device information)

7.2 Data Sharing

We do not sell, trade, or otherwise transfer your personal information to third parties. Your data is never shared with external parties except:

• Service providers who assist in operating our platform (bound by confidentiality)
• When required by law or legal process
• To protect our rights, privacy, safety, or property

7.3 Data Storage

• Your files and renderings are stored in secure cloud storage within the United States
• Account data is stored in our secure database systems within the United States
• We implement industry-standard security measures to protect your data

7.4 Data Retention

• Active account data is retained indefinitely while your account is active
• Upon account deletion, your data is permanently removed within 30 days
• Backup copies may persist for up to 90 days

7.5 Cookies and Tracking

We use cookies only for essential functionality, including:

• Session management (keeping you logged in)
• Security and fraud prevention
• Remembering your preferences

We do not use advertising cookies, tracking pixels, or third-party analytics.

8. Account Termination

8.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion:

• Your data will be permanently deleted within 30 days
• No refunds will be provided for remaining subscription time

8.2 Termination by Us

8.3 Effect of Termination

• You remain liable for all fees incurred prior to termination
• Sections of these Terms that by their nature should survive will continue to apply

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

9.2 AI-Generated Content

We do not guarantee:

• The accuracy, quality, or suitability of AI-generated renderings
• That generated content will meet your expectations or requirements
• That AI models will always be available or produce consistent results

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages arising from unauthorized access to your account or data
• Damages arising from errors, bugs, or service interruptions

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9.4 Third-Party Services

We use third-party AI models and services. We are not responsible for:

• The availability, performance, or results of third-party AI models
• Changes to third-party pricing or terms
• Third-party service interruptions or failures

10. Indemnification

You agree to indemnify, defend, and hold harmless Arch AI, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content or generated content

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• We will notify you via email or through the Service
• Continued use of the Service after changes constitutes acceptance of the new Terms
• If you do not agree to the changes, you must stop using the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change pricing, features, or subscription plans with 30 days' notice
• Impose usage limits or restrictions
• Remove or modify AI models or features

These Terms are governed by the laws of the jurisdiction where Arch AI is operated, without regard to conflict of law principles.

13.3 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

14. General Provisions

These Terms constitute the entire agreement between you and Arch AI regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
